HSH Licensing Disclosure

HSH.com (“HSH”) is a website owned and operated by HSH.COM LLC, a Nevada limited liability company with its headquarters in Las Vegas, Nevada. HSH publishes mortgage information and also allows mortgage lenders and mortgage brokers to market their products and services to consumers.

The HSH website also hosts loan inquiry forms where consumers can provide some information about the loan they are seeking so that lenders and mortgage brokers who may be able to help that consumer with a loan can reach out to the consumer about their loan products. These loan inquiry forms are operated by Quinstreet Media, Inc. (NMLS #2547), a California corporation with its headquarters at 2800 Olympic Blvd, Floor 1, Santa Monica, CA 90404 (“QSM”). Quinstreet Media, Inc. is a wholly owned subsidiary of HSH.COM LLC. QSM has no affiliation with QuinStreet, Inc. QSM does not do business as “HSH” or operate the HSH website. QSM merely operates the loan inquiry forms on the HSH website.

QSM does not originate or make loans nor make any credit decisions in connection with loans. QSM does not issue loan commitments or lock-in agreements. It does not solicit a loan for you and will not help or assist you to obtain a loan. QSM is not an agent of either you the consumer or of any participating bank, lender or mortgage broker (referred to in the rest of this document as "Lenders"). QSM provides only administrative and marketplace services, by matching consumers, who are prospective borrowers, with Lenders who may be willing to make them mortgage loans.

You must rely on your own judgment in deciding which available loan product suits your needs and financial means and whether or not to work with any Lender of which you become aware via HSH or QSM. You are under no obligation to use HSH or the QSM loan inquiry forms to begin any financing process. QSM does not guarantee that submitting requested information on HSH will result in the origination of a loan from a Lender. The information you submit to QSM is NOT an application for credit. QSM merely provides your information to certain lenders so that they may contact you directly. QSM cannot guarantee that you will receive a loan with the most advantageous rate or terms or that better rates and terms are not available from Lenders in your area not participating in the QSM marketplace.

You will have to complete an application with a Lender before they will extend an unconditional loan offer. The Lender you select may require you to pay an application fee to cover the costs of an appraisal, credit report or other items. The Lender will determine the amount of any such fees. The Lender must provide you with certain information regarding whether any such fees are non- refundable. Neither HSH nor QSM will charge you, the consumer, any fees for its services.

QSM and/or HSH receive their compensation directly from Lenders for the services provided. QSM and/or HSH’s compensation may vary, but will never exceed $200.00 per lead.

Federal Disclosures

QSM will forward the information you provide to certain Lenders. These Lenders must make certain disclosures to you as required by the Federal Truth In Lending Act (TILA), the Real Estate Settlement Procedures Act (RESPA) and other federal and state laws. These disclosures include details of your cost of credit, good faith estimates of your settlement costs, certain HUD mandated booklets, notice that your mortgage loan servicing may be transferred and your right to a copy of any appraisal performed on your home.

The Equal Credit Opportunity Act prohibits creditors from discriminating against credit applicants on the basis of race, color, religion, national origin, sex, marital status, age, because all or part of the applicant's income derives from any public assistance program, or because the applicant has, in good faith, exercised any right under the Consumer Credit Protection Act. The Federal Trade Commission administers compliance with these laws and may be contacted at: The Federal Trade Commission, Equal Credit Opportunity, Washington, D.C. 20580. The foregoing requirements are mandatory for Lenders, however neither QSM nor HSH makes any representations as to the adequacy or compliance on behalf of any Lender.

State Disclosures and License Information

Certain States may require QSM to obtain a license in order to provide these services within their state. Other States may not. Some States may require additional information disclosures be given to you in connection with the provision of these services. QSM reserves the right to refuse to accept or use the information you provide if such acceptance or use would constitute a violation of law or the terms and conditions of use for the HSH.com website.

The following statements provide information that may be applicable to you if you reside in, or are considering the purchase of property in one of the listed States.

State mortgage regulators launched the Nationwide Mortgage Licensing System (“NMLS”) in January 2008 to provide centralized and standardized online license management. The process of transitioning each state’s mortgage licensees to the NMLS has continued since the launch with the assignment of Unique Identification Numbers to facilitate licensee oversight and accountability. More information about the NMLS is available at www.stateregistry.org.

If the information you supplied to QuinStreet Media, Inc. is forwarded to a Lender, the Lender may issue to you a Financing Agreement in accordance with D.C. Code Ann.§ 1113. If such a Financing Agreement is issued on a single to 4-family home to be occupied by the borrower the Lender must provide the following information: (A) The term and principal amount of the loan; (B) An explanation of the type of mortgage loan being offered; (C) The rate of interest that will apply to the loan and, if the rate is subject to change, or is a variable rate, or is subject to final determination at a future date based on some objective standard, a specific statement of those facts; (D) The points and all fees, if any, to be paid by the borrower or the seller, or both; and (E) The term during which the financing agreement remains in effect.

If all the provisions of the financing agreement are not subject to future determination, change, or alteration, the financing agreement shall constitute a final binding agreement between the parties as to the items covered by the financing agreement.

The financing agreement executed by the Lender shall be delivered to the borrower at least 72 hours before the time of settlement agreed to by the parties.

A borrower aggrieved by any violation of this section shall be entitled to bring a civil suit for damages, including reasonable attorney's fees, against the Lender.

At your written request, you will be informed whether or not a consumer report was requested, and if a report was requested, you will be informed of the name and address of the consumer reporting agency that furnished the report.

QuinStreet Media, Inc. will not act as your lender or credit provider. QuinStreet Media, Inc. will submit the information you provide to potential Lenders and those Lenders may contact you with their offers.

QuinStreet Media does not accept any fees from the consumer, including third party fees.

A consumer protection bond is on file with the State of Maine. If you have a claim against our company which cannot be resolved through informal means, you may institute an action to recover your loss from that bond by filing a written complaint with the Director, Office of Consumer Credit Regulation, 35 State House Station, Augusta, Maine 04333-0035.

QuinStreet Media, Inc. will not seek or accept fees from consumers submitting an inquiry.   4. You have the RIGHT to know what fees are nonrefundable if you decide to withdraw your loan application.

  6. You have the RIGHT to know how much the mortgage broker is getting paid by you and the lender for your loan.
  7. You have the RIGHT to ask questions about charges and loan terms that you do not understand.
  8. You have the RIGHT to a credit decision that is not based on your race, color, religion, national origin, sex, marital status, age, or whether any income is derived from public assistance.
  9. You have the RIGHT to know the reason if your loan application is turned down.
  10. You have the RIGHT to receive the HUD settlement costs booklet “Buying Your Home”.”

If a Lender requests that you fill out an application for a mortgage loan, which Lender shall provide you with the following additional notice:

CONSUMER CAUTION AND HOME OWNERSHIP COUNSELING NOTICE

If you obtain this loan, the lender will have a mortgage on your home. You could lose your home, and all money you have invested in it, if you do not meet your obligations under the loan, including making all your payments.

Mortgage loans rates and closing costs and fees vary based on many factors, including your particular credit and financial circumstances, your earnings history, the loan-to-value requested, and the type of property that will secure your loan. You should shop around and compare loan rates and fees. This particular loan may have a higher rate and total points and fees than other mortgage loans. You should consider consulting a qualified independent credit counselor or other experienced financial adviser regarding the rate, fees, and provisions of this mortgage loan before you proceed. This agreement will remain in effect as long as you wish to use the services offered by QuinStreet Media, Inc. You may terminate this relationship at any time, without notice, at no cost or penalty to you.
